These terms are the agreement between you and Ponce Core Tech, LLC ("we", "us") for your use of Bimini — the web application, the mobile app, and poncecore.tech. By creating an account or using Bimini, you accept them. If you do not accept them, do not use Bimini.
The single most important term. Bimini is an educational tool, not a medical one. It does not diagnose, treat, or prescribe, and nothing it produces is medical advice. Never delay seeking care, and never disregard advice from a clinician, because of something Bimini told you. If you think you may have a medical emergency, call your doctor or emergency services immediately.
Bimini organizes health data you already have — wearable metrics, laboratory results, documents, medications, history — into one picture, and uses an AI guide called Ponce to help you understand it and to prepare summaries you can bring to your physician.
Bimini is not a medical device, is not cleared or approved by any regulator, and performs no clinical function. It is an organizational and educational tool. Clinical decisions belong to licensed clinicians.
You must be 18 or older and able to form a binding contract. Bimini is offered for your own personal, non-commercial use, for your own health data. Do not use Bimini to store or process another person's health information without a legal right to do so.
Bimini is a prototype in limited beta. That is not a formality:
Do not make Bimini your only copy of anything. Keep your original lab reports and records where you kept them before.
Ponce's responses are generated by a large language model. Language models produce fluent, confident text that can nonetheless be wrong, incomplete, or out of date. They can misread a document, transcribe a value incorrectly, or state something plausible that is false.
You are responsible for verifying anything you intend to act on with a qualified clinician. Any document Bimini generates for your physician is a draft summary of your own data — the reviewing clinician is responsible for confirming its accuracy against source records.
Ponce is commerce-blind by design: it recommends categories of intervention and evidence grades, never specific brands, and no third party pays for placement in its output.
You are responsible for keeping your account credentials secure and for activity under your account. Tell us promptly if you believe it has been compromised.
You agree not to:
You own your health data. Uploading it to Bimini does not transfer ownership.
You grant us only the license needed to run the service for you: to store, process, transmit and display your content for the purpose of providing Bimini to you, including transmitting relevant portions to our AI provider as described in the Privacy Policy. That license ends when you delete the content or your account.
We do not use your health data to train AI models, and we do not sell it.
How your data is handled is governed by the Privacy Policy, which forms part of these terms. Please read it — particularly the section on the AI provider.
If you connect a third-party account such as an Ōura Ring, your use of that service is governed by that provider's own terms and privacy policy. We are not responsible for their service, their availability, or the accuracy of the data they supply. You can disconnect at any time.
The beta is provided free of charge. If we introduce fees, we will tell you in advance and you will be able to decline and stop using the service.
To the fullest extent permitted by law, Bimini is provided "as is" and "as available", without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that Bimini will be uninterrupted, secure, or error-free, or that any output — including any measurement, interpretation, or summary — is accurate or complete.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of or inability to use Bimini.
Our total aggregate liability arising out of these terms or Bimini is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars (US$100).
Nothing in these terms excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
You agree to indemnify and hold harmless Ponce Core Tech, LLC and its officers and contractors from claims arising out of your misuse of Bimini, your violation of these terms, or your infringement of another party's rights.
You may stop using Bimini and delete your account at any time. We may suspend or terminate access if you breach these terms, if we reasonably believe it is necessary to protect members or the service, or if we discontinue the beta. Where practical we will give notice and an opportunity to export your data.
Sections that by their nature should survive termination — ownership, disclaimers, limitation of liability, indemnity, and governing law — do.
We may update these terms. For material changes we will notify you in the app before they take effect. Continuing to use Bimini after that constitutes acceptance. The effective date at the top always reflects the current version.
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Colorado have exclusive jurisdiction, except where your local consumer-protection law grants you a right to your own forum.
These terms and the Privacy Policy are the entire agreement between us regarding Bimini. If a provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger or sale of assets.
